Terms of Service

Last updated: 1 April 2026

1. Acceptance of Terms

By accessing or using the TutorLink platform (the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms in their entirety, you may not use the Platform. TutorLink is operated by TutorLink (Pty) Ltd, a company registered in South Africa (“TutorLink”, “we”, “us”, or “our”).

We reserve the right to amend these Terms at any time. Continued use of the Platform after any such changes constitutes your acceptance of the updated Terms. We will notify registered users of material changes via email.

2. User Accounts

To access certain features of the Platform you must register for an account. You agree to:

  • Provide accurate and complete registration information.
  • Keep your password confidential and not share it with any third party.
  • Notify us immediately of any unauthorised access to your account.
  • Be solely responsible for all activity that occurs under your account.

You must be at least 18 years of age or have the consent of a parent or legal guardian to create an account. TutorLink reserves the right to suspend or terminate accounts that violate these Terms.

3. Tutor Listings

Tutors may create a profile listing their tutoring services on the Platform. By creating a listing, you represent and warrant that:

  • All information provided in your profile is accurate and truthful.
  • You are enrolled at or have graduated from the university displayed on your profile.
  • You have the knowledge and ability to provide the tutoring services you advertise.
  • You will not misrepresent your qualifications, grades, or academic standing.

TutorLink does not verify academic credentials and bears no liability for the quality of tutoring sessions arranged through the Platform. All sessions are arranged directly between students and tutors.

4. Payments and Subscriptions

Students may browse the Platform and contact tutors free of charge. Tutors are required to purchase a subscription to maintain an active listing on the Platform.

  • Subscription fees are charged in South African Rand (ZAR) and are displayed at checkout.
  • Subscriptions are non-refundable unless required by applicable South African consumer protection law.
  • TutorLink does not process payments between students and tutors. All session fees are agreed upon and paid directly between the parties.
  • We reserve the right to change subscription pricing with 30 days’ written notice to registered tutors.

5. Acceptable Use

You agree not to use the Platform to:

  • Post false, misleading, or fraudulent content or advertisements.
  • Harass, threaten, or intimidate other users.
  • Engage in any unlawful activity, including academic dishonesty (e.g. completing assignments or assessments on behalf of a student).
  • Scrape, crawl, or otherwise extract data from the Platform without our prior written consent.
  • Introduce malicious code, viruses, or any other harmful software.
  • Attempt to gain unauthorised access to any part of the Platform or its infrastructure.

Violation of this section may result in immediate account suspension and, where appropriate, referral to law enforcement authorities.

6. Intellectual Property

All content on the Platform — including but not limited to text, graphics, logos, and software — is the intellectual property of TutorLink or its licensors and is protected by applicable South African and international intellectual property law.

You retain ownership of any content you submit to the Platform (such as your tutor profile and bio), but you grant TutorLink a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content for the purposes of operating and promoting the Platform.

7. Limitation of Liability

To the maximum extent permitted by South African law, TutorLink and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform or any tutoring services arranged through the Platform.

TutorLink is a marketplace connecting students and tutors and is not a party to any tutoring arrangement. We do not guarantee the quality, safety, or legality of any tutoring session.

Nothing in these Terms limits TutorLink’s liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
